SERVICES AGREEMENT
PAGESIM
This Services Agreement (“Agreement”) is entered into between pagesim (“ABN: 13 925 709 863”) and the undersigned client (“Client”).
By booking and making payment, the Client agrees to the following terms.
1. Services
pagesim provides strategic industry mentoring and business guidance tailored to creative and talent professionals.
During sessions, pagesim will:
Develop a robust understanding of the Client’s goals, positioning, and current situation
Discuss key strategic questions relating to career direction, market positioning, branding, contracts, and agency readiness
Provide insights into the current industry landscape and practical next steps
Provide a summary document post call to summarise
Sessions may include career strategy, portfolio feedback, media kit direction, brand clarity, agency approach strategy, or contract discussion.
Services are provided in a strategic advisory capacity only and do not constitute representation, management, legal advice, or employment services.
2. Acknowledgements
The Client acknowledges that:
pagesim can not guarantee any specific outcomes, including agency signing, representation, financial results, bookings, brand deals, or career progression, as agencies and third parties operate independently and at their own discretion.
pagesim is not a medical professional, psychologist, or licensed therapist. Advice provided is based on the information shared by the Client and is specific to industry and business matters.
The Client remains fully responsible for all final decisions and actions taken.
If concerns arise regarding wellbeing or safety, pagesim reserves the right to recommend external professional support.
No guarantee is made regarding specific financial outcomes, bookings, brand deals, or career results.
3. Contract Review
Where services include reviewing contracts, pagesim provides strategic and industry-based commentary only. pagesim is not acting as a lawyer and does not provide legal advice. Independent legal review is strongly recommended before signing any contract, pagesim can recommend lawyers.
4. Intellectual Property
Unless otherwise agreed in writing:
The Client owns their personal brand, materials, and final creative outputs.
pagesim retains ownership of all frameworks, templates, methodologies, and intellectual property used during sessions.
Materials provided may not be copied, resold, distributed, or shared without written consent.
pagesim may reference non-confidential aspects of work in a portfolio or case study format unless the Client requests confidentiality in writing.
5. Confidentiality
All sessions are strictly confidential.
pagesim agrees not to disclose private information shared by the Client, except:
Where required by law
Where there are genuine concerns regarding the Client’s safety or wellbeing
The Client agrees not to share proprietary frameworks, session recordings (if applicable), or materials without written permission.
6. Integrity & Independence
pagesim operates independently.
pagesim will never:
Accept payments, commissions, or affiliate incentives from agencies for referrals
Prioritise agency relationships over the Client’s best interests
pagesim may interview, meet with, and develop professional relationships with agencies solely for the purpose of industry research, data gathering, and remaining informed on current market offerings and standards.
7. Payment & Fees
A 50% deposit is required to secure your booking.
For The Entry and The Reset, the remaining 50% is due prior to the final presentation session.
For the PS Hotline, full payment is due upon conclusion of the session. Late payments attract a 5% late fee per week overdue. Failure to complete payment may result in suspension of services and legal escalation.
Deposits are non-refundable unless otherwise agreed in writing.
If you are experiencing financial hardship, payment plans may be offered at the discretion of pagesim and must be agreed to in writing prior to commencement of services.
All agency consulting engagements operate under a separate deal memo and scope of work, agreed in writing prior to commencement.
P.S… consulting fees may be tax deductible for you. We recommend checking with your accountant to confirm based on your individual circumstances.
8. Limitation of Liability
To the fullest extent permitted by law:
The Client agrees that pagesim’s liability is limited to the total amount paid for services.
pagesim is not liable for indirect, consequential, or business losses arising from decisions made by the Client.
9. Termination
Either party may terminate this Agreement with 7 days written notice.
If terminated:
Any unpaid invoices remain payable immediately upon termination. Deposits are non-refundable where work has commenced. Any incomplete work will cease upon termination. pagesim reserves the right to invoice on a pro rata basis for services delivered up to the date of termination.
10. Governing Law & Dispute Resolution
This Agreement is governed by the laws of Victoria, Australia. In the event of a dispute, both parties agree to raise the matter in writing and commit to resolving it in good faith within 14 days. If unresolved, both parties agree to engage an independent mediator before pursuing legal action.
